Buyers and Sellers Terms

(BUYERS TERMS) 

SELLERS MODE OF OPERATION 

Our vision statement is to help Vendors sell their Products and help them develop their activity. The Products on sale on the website are exclusively unique and trending international products meaning: 

  • The Platform enables the Vendor to create their virtual shop using a unique account associated to an e-mail address, username and password. 
  • House of Doers also offers promotional tools to the Vendors (for example reduction coupons, partners offer etc.). The use or not of such tools offered by us is under the sole responsibility of the Vendor. 

We forbid each vendor to list and offer to sale on the website any Products that is: 

  1. explicitly unauthorized products to sale by on the Website;  
    (ii) against the law and regulation effective or the good customs and morals or unauthorized, notably Prohibited Products, or products violating the rights of a third party, sold in violation of selective or exclusive distribution network 

House of Doers brings to the Vendor’s attention the absolute necessity for the Vendor that puts a Product on the market and especially to be sold on the Platform, to ensure that products on House of Doers website is strictly conform to all legislation, ruling and other prescriptions applicable, starting from its production or fabrication to its purchase by the Buyer. Therefore, the Vendor commits to engage all means necessary to reach this obligation of legal conformity, especially the implementation of auto-controls at all steps of the commercialization and the justification on demand of the competent authorities to control and verify accordingly.  

If we notice a User the selling of Prohibited Products on the website, we have the reserve right: 

  • To remove the Prohibited Products or any Products contrary to the present Terms & Conditions. 
  • To ban, suspend, close or suspend the account of the Vendor. 
  • Report to necessary authorities all information required regarding the sell offer and/or buy of any Prohibited Product on the website, including the nominative information of Users if necessary and/or cooperate with the competent authorities on demand. 

Vendors is saddle with the following responsibilities in lieu to the process of selling a product on our website; 

  • The Vendor is charged to cater for all responsibility in the event of the complaint, action, claim of a third party against the non-conformity of a Product to the applicable legislation, and to not involve AFRIKFARE of all consequences linked to the non-conformity of his Products to the laws and rulings applicable. 
  • The Vendor commits accordingly to take directly to his charge the payment of all sums, including all eventual condemnations, legal fees, lawyer’s fees and other amounts that might be due to this effect. 
  • The Vendor commit to keep all information on the Buyer confidential and do not share them.  
  • The Vendor also commits to use the contact details and other data communicated by the Vendor only for the purpose of ordering processing and the legal obligations corresponding. Notably the Vendor commits to not propose to the Buyer products available outside the Platform and not to use the personal information of a Buyer for other objectives than the execution of the order on the Site. 

 RECLAMATIONS AND RETRACTION RIGHT 

The reclamations, reclamation right use and refunding queries done by the Buyer must be addressed to the Vendor, and managed between first, and if they cannot achieve either can then contact House of Doers at any time, only if needed. The Buyer and Vendor can each follow the procedure in their respective account and will benefit from an alert system in their order tracking area. The Buyer and the Vendor will act with all necessary diligences to the good resolution of the reclamation, under our supervision and the final decision to refund the Buyer belongs to us If the Vendor refuses to oblige to a claim, the retraction, cancellation, or return demand formulated by the Buyer or does not treat this claim in the 48 hours following its issuance, we can study the claim or demand of the Buyer and, in case of abusive refusal or non-treatment by the Vendor, to refund the Buyer of the order amount concerned. 

In the event of a reclamation linked to a non-conform Product or to the use of the retraction right, the Buyer pledges to send back the Product to the Vendor. In particular the Buyer commits to pack correctly the Product and to take the effective precautions to its shipment. 

The Buyer that paid a Product by credit card through the secure payment system of the Platform will be refunded on his Merchant Wallet. In the event of a refund on this Wallet the Buyer can use the Merchant Wallet to realize other purchases on the Platform or at all-time ask for transfer the amount on his wallet to be credited on his bank or PayPal account. 

COMMISSION AND OTHER CHAREGES 

We get paid on the intermediation between Buyer/Vendor and perceive a commission according to the principles described in this agreement. 

In compensation of the intermediation service supplied by House of Doers, the Vendor agrees to pay us, following the acceptation of the order and its payment; 

  • Refund to the Buyer, the commission due to us will be deducted from the next commissions, in proportion to the amount refunded to the Buyer and the Vendor commits to pay the rest of the commission due. In these cases, the refund will be done pro rata of the amount refunded to the Buyer and the Vendor commits to pay us of the commission balance eventually due. It is however stipulated that we will not refund the commission to the Vendor in the hypothesis where (I) the Vendor refuse to acknowledge a claim of a Buyer or does not treat in less than 48 hours and we refunds the Buyer or (ii) more generally, if the Vendor does not respect the obligations stipulated in the present Terms & Conditions of Use. In the event of the implementation by our specific operations (such as affiliation programs and/or partnerships with other companies and/or websites), the amount of the commission planned in these Terms & Conditions might be modified. In this case, we will inform in advance each User of the commission applied for such operation. 

We reserve the right without indemnity, to modify its policy regarding the sale of Products on the Platform and/or the commission received by House of Doers and inform its Users. In the event of reduction of such commissions and fees, these modifications will be effective as soon as they’re on the Website. If the modification is temporary (for example during exceptional promotion days), the duration of this modification will also be communicated to the Users and displayed on the Website. In case of the rise of these fees and commissions, we will notify the Vendors that will be obliged to accept the new modifications. These modifications will be effective the month following the month during which these modifications were notified to the Vendors. If the Vendor does not accept the new applicable financial conditions, he is free to terminate his Account. 

PURCHASING 

House of Doers and its partners strive for complete accuracy in description and pricing of the products on the Site. However, due to mistakes, occasional glitches, nature of the internet, or service interruptions may cause inaccuracies to appear on the Site. We reserve the right to void any purchases that display an inaccurate price. If the displayed price is less than the actual price, House of Doers will void the purchase and attempt to contact you via either phone or email to inquire if you would like the item for the correct price. 

Under no circumstances will House of Doers its suppliers be held liable for any damages due to temporary interruptions in the availability of the Site. 

TYPES OF FEES 

Sellers may be charge with the following types of fees, please note that all fees are listed exclusive of any value-added tax (VAT) that may apply; 

  • Listing Fee: t\here is no charge for each item that you list for sale on houseofdoers.com. 
  • Transaction Fees: when you make a sale through houseofdoers.com, you will be charged a transaction fee of 5% of the price you display for each listing plus the amount you charge for delivery and gift wrapping.  
  • Payment Processing Fees: we charge a payment processing fee for each transaction through houseofdoers.com Payments processing channel usually around 3%. 
  • Advertising and Promotional Fee: this is the charge for advertising your product on our site. 
  • Delivery Fees: this are related shipping charges. 
  • Currency Conversion: we help you to converts fees from USD to your payment account currency at the market rate at the time the fee is reflected in your payment account. 
  • Taxes 

Aside from the unforeseen circumstances set out above, you are charged with the responsibility for collecting and paying any taxes associated with using and making sales through houseofdoers.com
